Terms of Use

Agreement

These terms are an agreement between you and the developer of Witilo ("we", "us") for the Witilo app and this website. By downloading or using Witilo you accept them, together with our Privacy Policy. If you do not agree, please do not use the app.

These terms work alongside Apple's Licensed Application End User License Agreement. Where the two differ, these terms apply, to the extent the App Store rules allow.

The app

We give you a personal, non-transferable, revocable licence to use Witilo on Apple devices you own or control, for your own non-commercial use. Games, levels and features may change, be added or be removed over time. We work to keep Witilo running, but we cannot promise it will always be available or free of errors.

Witilo Membership

Witilo Membership is an auto-renewing subscription. It removes energy limits and ads and opens every game and the whole Path.

• Plans: yearly or monthly. The price and billing period for your country are shown in the app before you buy.
• Payment: charged to your Apple Account when you confirm the purchase.
• Renewal: the membership renews automatically for the same period and price unless you cancel at least 24 hours before the current period ends. Your Apple Account is charged for renewal within 24 hours before the period ends.
• Price changes: if the price changes, Apple tells you in advance and, where required, asks for your consent.
• Restore: if you reinstall or move to another iPhone with the same Apple Account, tap Restore purchases.

Cancelling and refunds

Cancel any time in iOS Settings → your name → Subscriptions → Witilo. Membership stays active until the end of the period you have paid for. Deleting the app does not cancel the membership.

Payments are processed by Apple, so refunds are handled by Apple under its policies. You can ask for one at reportaproblem.apple.com. Nothing in these terms limits any refund rights you have under the law where you live.

Energy and rewards

Free players use energy to play. Energy, stars, chests, badges, levels and scores are part of the game. They have no money value, cannot be sold or exchanged, and may be rebalanced as the game changes. Optional reward videos are provided by third parties and may not always be available.

Fair use

Please do not copy, modify, reverse engineer or resell the app; interfere with its servers or other players' data; use bots or cheats to manipulate scores or rewards; or send abusive or unlawful content through the feedback form. We may limit or stop access for anyone who breaks these rules.

Our content

The Witilo name, logo, games, artwork, text and code belong to us or our licensors and are protected by law. Ideas you send us in feedback can be used to improve Witilo without any obligation to you.

Not medical advice

Witilo offers games for fun and everyday practice. It is not a medical device and does not diagnose, treat or prevent any condition. Scores and charts show how you do in our games, not a medical measure of your brain. If you have concerns about your memory or health, speak to a doctor. Some games use quick movement or flashing elements; take a break if you feel unwell.

Liability

Witilo is provided "as is". To the extent the law allows, we are not liable for indirect or consequential loss, or for loss of data, and our total liability to you is limited to the amount you paid for Witilo in the twelve months before the claim. Nothing in these terms excludes liability that cannot be excluded by law, or limits your statutory rights as a consumer.

Apple

These terms are between you and us, not Apple. Apple is not responsible for Witilo or its content, has no obligation to provide maintenance or support, and is not responsible for any claims relating to the app. If Witilo fails to meet any applicable warranty, you may tell Apple, and Apple may refund the purchase price, if any. Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you. You confirm that you are not in a country subject to a U.S. Government embargo and are not on any U.S. Government list of prohibited or restricted parties.

Changes

We may update these terms as Witilo changes. We will update the date at the top and, for important changes, tell you in the app. If you keep using Witilo after a change, the new terms apply. If you do not agree, stop using the app and cancel any membership.
